Disclaimer (Muslim Wills): The ADJD Civil Wills Office has recently introduced the option for Muslims to register wills under civil law principles. While this development offers greater flexibility in estate planning, its enforceability before UAE courts remains subject to judicial interpretation and compliance with applicable laws. Registration does not guarantee execution of the will in all circumstances. Accordingly, this step should be considered a precautionary measure rather than an absolute assurance of outcome.

Furthermore, Muslim Wills may be drafted and executed in accordance with applicable UAE civil laws. While the drafting may reflect the testator's wishes and Islamic principles, the Will is structured for execution under the UAE legal framework. In the event of any dispute, challenge, or contest by heirs, the ultimate interpretation and enforcement of the Will shall be subject to the discretion of the competent UAE court. Provided that the Will is not challenged or contested by any heir, it can be fully executed in accordance with its terms.

Islamic inheritance (beneficiaries): Under Islamic inheritance principles, a testator may freely dispose of up to one-third (1/3) of their estate by will. Any allocation exceeding this one-third limit may be subject to challenge. This portion may be distributed as a hibah (gift), charitable donation, or granted to any individual or entity chosen by the testator.

An executor is the person responsible for carrying out the instructions in your Will after your death. This includes managing your assets, paying any outstanding debts or taxes, and distributing your estate to your beneficiaries in accordance with your wishes.
